1. Agreement to these terms
Kamentos is a social media management and automation platform operated by Tecsy International. By creating an account, accessing a workspace, connecting a third-party service, or using any Kamentos feature, you agree to these Terms of Service and confirm that you have authority to accept them for yourself or the organization you represent.
2. The Kamentos service
Kamentos provides tools for social media publishing, scheduling, engagement, team collaboration, content review, analytics, lead management, AI-assisted replies, and integration management. The specific features available to you may depend on your plan, workspace settings, connected platforms, app review status, and third-party API availability.
3. Account registration and security
You must provide accurate account, company, and contact information. You are responsible for safeguarding passwords, verification codes, devices, and workspace access. You are responsible for actions taken through your account or workspace, including actions by invited team members. Notify us promptly at info@tecsyintl.com if you believe your account, connected platform token, or workspace has been accessed without authorization.
4. Workspace ownership and users
The person or organization that creates or controls a workspace is responsible for managing user roles, permissions, connected accounts, content approvals, and billing. If you invite team members, contractors, or clients, you must ensure they use Kamentos in compliance with these terms, applicable laws, and connected platform policies.
5. Connected social platforms
You may connect Facebook Pages, Instagram accounts, LinkedIn accounts, TikTok accounts, Google Business Profiles, and other supported services only when you have permission from the account owner. Your use of each connected service remains subject to that platform's terms, developer policies, community standards, API rules, review requirements, and technical limits.
When you connect a platform account, you authorize Kamentos to access, store, process, display, publish, retrieve, or analyze the data permitted by the scopes you approve, solely to provide the product features you choose to use. You can disconnect integrations from your workspace settings or revoke access directly through the connected platform.
6. Meta, Facebook, Instagram, and Page permissions
If you connect Meta services, including Facebook Login, Facebook Pages, Instagram, Messenger, comments, leads, or related Graph API features, you confirm that you are authorized to manage those assets and that your use will comply with Meta's Platform Terms, Developer Policies, Community Standards, and any permission-specific requirements. You may not use Kamentos to scrape data, send spam, misrepresent your identity, collect data without proper notice or consent, or use Page, messaging, engagement, or lead data outside the permitted business purpose.
7. Customer content and permissions
You retain ownership of content, media, captions, comments, messages, leads, brand materials, documents, prompts, training data, and other materials you provide or connect to Kamentos. You grant Kamentos a limited license to host, process, transmit, display, modify, and use that content as needed to operate the service, provide support, secure the platform, improve reliability, and perform actions you request.
You are responsible for ensuring that your content does not infringe intellectual property rights, violate privacy rights, break advertising or platform rules, include unlawful claims, or contain malicious, deceptive, abusive, or harmful material.
8. Publishing, messaging, leads, and automation
You control the content, schedules, audiences, Pages, accounts, recipients, approval settings, and automation settings used through Kamentos. You are responsible for reviewing content before it is published or sent, especially when using automated or AI-assisted features. Kamentos may provide drafts, recommendations, scheduled actions, or automated replies, but you remain responsible for the final use of those outputs and for complying with applicable laws and platform policies.
9. AI-assisted features
Kamentos may use AI providers to generate drafts, replies, summaries, lead classifications, recommendations, or insights based on your workspace settings and training materials. AI output may be inaccurate, incomplete, offensive, outdated, or unsuitable for your business context. You should review AI output before relying on it where accuracy, compliance, brand safety, or customer impact matters.
You must not use AI features to create unlawful content, impersonate others, deceive users, violate platform policies, process sensitive data without authorization, or make decisions that require human judgment without appropriate review.
10. Privacy and data deletion
Our handling of personal information is described in the Privacy Policy. Instructions for requesting account, workspace, and connected platform data deletion are available on the Data Deletion Instructions page. You are responsible for providing any notices and obtaining any consents required for data you upload, collect, or process through Kamentos.
11. Acceptable use
You must not use Kamentos to:
- Violate any law, regulation, platform rule, intellectual property right, privacy right, or contractual obligation.
- Send spam, deceptive messages, unauthorized promotions, malware, phishing attempts, or abusive content.
- Collect, store, or use personal data without a lawful basis, required consent, or proper notice.
- Bypass platform safeguards, rate limits, permission reviews, security controls, or access restrictions.
- Interfere with Kamentos, connected platforms, other users, or the security and reliability of any system.
- Reverse engineer, copy, resell, sublicense, or misuse the service except as permitted by a written agreement.
12. Plans, trials, billing, and taxes
Kamentos may offer free trials, founding access, paid plans, usage limits, or custom subscriptions. Plan details, prices, limits, and billing intervals may change with notice where required. Unless a separate written agreement states otherwise, you are responsible for applicable fees, taxes, and charges associated with your workspace. Failure to pay may result in downgraded, suspended, or terminated access.
13. Third-party services and API availability
Kamentos depends on third-party platforms and infrastructure providers. Features may be delayed, limited, suspended, or unavailable because of platform outages, API changes, app review decisions, permission restrictions, rate limits, account status, policy enforcement, or provider errors. Kamentos is not responsible for third-party services, platform decisions, removed content, rejected permissions, disabled accounts, or API limitations.
14. Service changes and availability
We work to keep Kamentos secure and available, but we do not guarantee uninterrupted service. We may update, improve, suspend, restrict, or discontinue features when needed for security, maintenance, legal compliance, platform policy compliance, business reasons, or product improvement.
15. Suspension and termination
You may stop using Kamentos and disconnect integrations at any time. We may suspend or terminate access if we believe your use creates legal, security, platform-policy, abuse, nonpayment, or operational risk; if you materially violate these terms; or if required by a connected platform, law, regulator, or court order. After termination, we may retain or delete data according to the Privacy Policy, Data Deletion Instructions, legal requirements, backups, and legitimate operational needs.
16. Intellectual property
Kamentos, including its software, interfaces, branding, design, workflows, documentation, and underlying technology, is owned by Tecsy International or its licensors. These terms do not transfer ownership of Kamentos to you. You may use Kamentos only as permitted by these terms and any applicable plan or written agreement.
17. Feedback
If you provide ideas, suggestions, bug reports, feature requests, or other feedback, you allow us to use that feedback without restriction or compensation, while you retain ownership of any separate content or materials you submit.
18. Disclaimers
To the fullest extent permitted by law, Kamentos is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, secure, compatible with every platform requirement, or suitable for every business purpose. We do not guarantee specific business results, social media performance, leads, engagement, app review approval, platform approval, or revenue.
19. Limitation of liability
To the fullest extent permitted by law, Tecsy International and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data, or business opportunity; platform enforcement actions; or content published, sent, or automated under your direction. Our total liability for claims relating to Kamentos will not exceed the amount you paid to Kamentos for the service in the three months before the event giving rise to the claim, or USD $100 if no amount was paid.
20. Indemnity
You agree to defend, indemnify, and hold harmless Tecsy International from claims, damages, liabilities, costs, and expenses arising from your content, your connected accounts, your use of Kamentos, your violation of these terms, your violation of law or platform policy, or your infringement of third-party rights.
21. Changes to these terms
We may update these terms as the service, legal requirements, or platform policies change. The latest version will be posted on this page with an updated effective date. Continued use of Kamentos after an update means you accept the revised terms.
